Your obligations as an intermediary
From the moment you take the mandate, the agency publishing the listing carries precise EPC obligations, set by the Brussels-Capital Region and enforced by Brussels Environment.
- Certificate drawn up before the property goes on the market
Every individual dwelling of 18 m² or more put up for sale or rent in the Brussels-Capital Region must hold an EPC certificate, drawn up before the property is put on the market.

Is the agency liable if the energy class is missing from the listing?
Yes. The intermediary publishing the listing must state the property's energy class in it: small ad, Internet, poster or agency window, as Brussels Environment points out. In the event of an infringement, the report is forwarded to the Public Prosecutor and an administrative fine of €50 to €62,500 may be imposed.
Is the certificate needed before publishing the listing, or only when the sales agreement (compromis) is signed?
Before the listing. In Brussels, the EPC certificate must be drawn up before the property is put on the market, and the energy class appears from the very first advertisement, according to Brussels Environment. Book the visit as soon as you have the mandate; if the signing is approaching, we visit within 48 hours.
What is the fine for a listing without an EPC in Brussels?
€50 to €62,500. Brussels Environment draws up a report forwarded to the Public Prosecutor; in the absence of criminal proceedings, its senior official may impose an administrative fine of €50 to €62,500. The penalty covers any infringement of the EPC regulations: missing certificate or energy class absent from the advertisement.
Can the seller pay for the certificate directly?
Yes. When ordering, you choose who receives the invoice: your agency, or directly the seller or the landlord. By law, the cost of the certificate is borne by the seller or the landlord and cannot be passed on to the buyer or the tenant, as Brussels Environment points out. One invoice per order.
Can we check whether a property already has a valid EPC certificate?
Yes, in the regional register peb-epb.brussels. An EPC certificate remains valid for ten years: for a property sold or let in the last ten years, a certificate may still be valid; ask the seller for it before ordering. If it has expired or cannot be found, book the visit from your pro account.
